What does this mean?
The Defendant has put in a defence to the proceedings. The Defendant can either enter a defence to the issue of liability (i.e. denying responsibility for the accident) or a defence to the amount of compensation you are claiming. We will send you a copy of the Defence.
What happens next?
Once the proceedings have been defended the court will decide what steps both parties must take to prepare the case for a final court hearing. These steps are known as “directions” and they usually consist of the following:-
- The date by which both parties should exchange documents that are relevant to the claim
- The date by which both parties should exchange witness statements
- The date by which both parties should exchange expert evidence (such as medical reports)
- The date and location of the final hearing
