What does this mean?
We have commenced court proceedings against the other driver on your behalf. The reason why we have commenced proceedings is most likely to be because liability is disputed or because the insurers have not made a reasonable offer to settle your claim.
What happens next?
- The court will tell us the date when the proceedings are assumed to have been received by the other driver (the Defendant). This is known as the “date of service”.
- The Defendant has a maximum period of 28 days from the date of service to defend the proceedings.
- If the Defendant does not put in a defence the court will assume that he/she has admitted the claim. The court will then set a date for a hearing for the purpose of deciding how much compensation you should receive.
