Court of Protection Solicitor/CILEX (COP002)

ROLE

You will be joining a specialist team that provides Deputyship and Trustee support to clients who have personal injury or clinical negligence claims and which involve the management of substantial compensation awards.

The primary role is to take the lead on a caseload of Deputyship and Trustee matters, both pre and post settlement of the PI claim:

  • To provide comprehensive advice and representation to clients and family members within the context of the Mental Capacity Act and other relevant legislation
  • Attending clients at their home, or in hospital or in care/nursing homes
  • Preparing accurate accounts on Deputyship cases including forecasts of expenditure on Deputyship and Trustee cases, including creating budgets to ensure funding sustainability
  • Delivery of accurate reports and client bills to the Court of Protection/SCCO
  • Arranging/overseeing either in person or by delegation the payment of Client bills and expenses
  • Liaising with case managers, care teams, health professionals, surveyors, architects and other relevant professionals and specialists
  • Management of Property and Affairs, Deputyship applications and other associated applications to the Court of Protection and OPG
  • Arrange for relevant Deputyship/Trustee cost witness statements on cases pre settlement
  • Completion of probate forms and oaths to enable Grants of Representation to be obtained in fatality cases within the organisation
  • Drafting of wills and LPA’s
  • Delegate and supervise tasks to junior team members where appropriate
  • Attending one-on-one meetings with team members to discuss particular cases and to assist in preparation of letters/forms as a result of these meetings
  • Assist with the workflow of the COP proclaim system by amending standard letters to reflect COP specific requirements as required
  • To attend team meetings and training sessions
  • To actively engage in business development plans

REQUIRED SKILLS AND EXPERIENCE

  • A minimum of 4 years PQE in Private Client and Court of Protection work
  • Strong leadership skills
  • An enthusiasm for team building and raising the internal and external profile of the team
  • Strong business networking skills
  • Excellent client care skills – i.e. the ability to speak to clients in a professional, empathetic and courteous manner
  • The ability to interact with colleagues and express opinions in a professional and courteous way
  • Excellent time management – i.e. the ability to complete given tasks within an acceptable timescale and to work within any given deadlines
  • The ability to work in an organised way
  • The ability to create management reports where necessary
  • Good IT skills, preferably a working knowledge of Proclaim or other similar case management systems
  • Attention to detail and the ability to prepare clear and concise file notes and memos
  • The ability to apply initiative and forward thinking
  • Compliance with office manual procedures
