Specialist Litigator (MNFT038)

To process the litigated cases, ensuring that the same are conducted in a proactive and commercially focussed manner. To assist with pre-litigation cases in team to ensure they are progressed efficiently and proportionaility to issue and service.


  • Managing 25 litigated medical negligence cases
  • Reviewing pre-litigation cases & preparing clear case plans for progression to litigation
  • Achieve KPI target of 65 chargeable units per day
  • Managing all aspects of litigation from service to Trial
  • Conducting litigated medical negligence claims of varying value up to £100,000.
  • Drafting Court documents including:
  1. Witness statements
  2. Schedules of Loss
  3. Directions Questionnaires
  4. Proposed Directions
  5. Lists of Documents
  6. Case Summaries
  7. Applications
  8. Agendas for Joint Meeting of Experts
  9. Skeleton Arguments
  10. Listing Questionnaires
  11. Tomlin & Consent Orders
  • Complying with all Court deadlines in a timely manner
  • Ability to do their own advocacy at Court hearings
  • Supervising & assisting the Teams Senior Paralegals in their development
  • Communicating, assisting & advising Tier 2 with the preparation of proceedings
  • Progress files in line with KPI targets.
  • Securing settlements of cases in line with targets
  • Preparing instructions to Counsel
  • Preparing letters of instruction to experts
  • Communicating and negotiating with the Defendant and their representatives
  • Considering medical evidence in relation to Breach of Duty, Causation and Condition and Prognosis prepared for the Claimant and Defendant
  • Considering Defences
  • Quantifying claims for General & Special Damages
  • Liaising with clients, experts, Counsel, Defendant’s Solicitors/ Representatives
  • Undertaking telephone negotiations/case management conferences with Solicitors/Courts as directed.
  • Ensuring all outstanding actions as per Proclaim Action Lists are completed in a timely fashion
  • Accurately recording time
  • Maintaining client files in good order and in accordance with Lexcel and other quality assurance requirements
  • Answering client queries on the telephone
  • Making sure clients are kept up to date
  • Preparing Trial and hearing bundles
  • Enthusiastically seeking out personal development


  • High levels of Clinical Negligence experience
  • High levels of litigation experience
  • Experience in drafting Court documents
  • Advocacy experience
