What is an assault at work claim?

We expect to be safe while at work but violence in the workplace, both verbal and physical, does unfortunately take place. Some industries have a statistically higher incidence of workplace assaults, but regardless of where you work, your employer has a duty to put suitable measures in place, in order to protect you from work-related violence.

Violence at work can take many forms but some examples of workplace assault include:

Physical assaults: for example, being hit, pushed, kicked or bitten by a patient or service user.

Verbal abuse: for example, being aggressively yelled at by a patient, visitor, or an irate customer.

Threatening or intimidating behaviour: for example, someone might threaten to hurt someone in the workplace.

Can I make a claim if I was assaulted at work?

If you’ve experienced violence at work, it’s important to report the incident to your employer in the first instance. While not all assaults are due to employer negligence, there are instances where a workplace assault could have been prevented, or its impact reduced, if the correct measures were taken. It could be that staff shortages exacerbated a dangerous situation, or that staff have not received adequate training to deal with potentially violent individuals.

How much time do I have to claim for workplace assault?

In most cases, your injury must have taken place in the last three years to be eligible to make a claim. This time restriction applies to those age 18 or older. If you were under 18 at the time of the assault, the three-year time restriction does not start until your 18th birthday.  There are some exceptions to the three-year rule, so please get in touch if you think you might you have a claim for compensation.
