The family of a woman described as a ‘living miracle’ after sustaining a severe brain injury when she was hit by a motorbike has thanked Fletchers Solicitors for securing significant damages for her.
The woman was crossing a road on foot when a motorcycle struck her, leaving her with serious injuries including traumatic brain injury. This caused impairment of her cognitive functions and ultimately meant she lost the capacity to manage her affairs.
Fletchers Solicitors has been involved with the case since meeting the family shortly after the accident happened in 2015.
Caroline Morris and Aimee Moorcroft handled the case and after negotiating a liability settlement for their client, they went on to secure a settlement figure to compensate for the injuries she sustained and the care and Court of Protection support she will require in the future.
Caroline Morris, a senior solicitor in the serious injury department at Fletchers, said: “Our client and her family have endured so much since this devasting accident. We are delighted to have been able to secure this settlement despite a liability dispute and disagreement between the parties about our client’s capacity.
“The settlement obtained will ensure that she is financially secure for the remainder of her life and supported by the Court of Protection team here at Fletchers Solicitors. We wish her and the family all the best for the future.”
The son has spoken of the years of struggles since the accident and how much all their lives have changed.
He said: “My mum has made a great recovery, the nurses call her a living miracle because of the extent of her injuries. The last four years have been non stop for all of us but I cannot stress enough the professionalism the whole team at Fletchers has shown when dealing with my mum’s claim.
“I am over the moon with the help, support and guidance that Fletchers provided to me and my family when my mum’s claim was going on.
“Over the four years, Fletchers provided support, not only for the claim, but also personal support and keeping the family up to date with different stages leading up to the final settlement.
“We’ve built up a really good relationship and I’m sure this will continue while working with the Court of Protection team who again cannot be any more helpful in providing their support and knowledge.
“I would like to thank Caroline Morris and Claire Barnes who I have had the most communication with in the team and show my appreciation for everything they have done.”
The woman’s daughter said: “I cannot thank Fletchers enough for all the work they put in with my mum and her case and all of us as a family, too.
“I would highly recommend them; not only did they do their very best for my mum, but they did their very best for the family and our care. As I acted as litigation friend, they helped me to understand things in a better sense and made sure I fully understood. We had the best outcome and it’s thanks to Fletchers.”
The settlement was approved at the Manchester District Registry earlier this year. The Claimant was represented by Christopher Melton QC of Byrom Street Chambers.
