A motorcyclist has been compensated in a serious injury settlement after a Land Rover Defender turned across her path and caused a horrific accident.
In August 2016, Christina Colegate from Monmouth in Wales overtook the defendant on her motorcycle on the A465 in Abergavenny before the defendant turned right across her path into a lay-by and caused a serious collision.
Christina sustained multiple injuries, specifically a compound fracture to her left arm, and fractures to her left wrist, tibia, fibula and femur.
Multi Track Solicitor Dale Bickerstaffe and Assistant Fee Earner Ceri Dudley from Fletchers Solicitor’s Serious Injury Catastrophic department successfully represented Ms Colegate.
“Traditionally, these can be 50/50 cases.
“The layby was not terribly obvious, but we managed to obtain good independent evidence from two witnesses regarding positioning, speed and timing.”
In the wake of the accident, Tina’s recovery progress was complicated.
Recurring infections delayed Tina’s recovery because of the need for multiple skin graft procedures.
There was also a possibility Tina’s left leg being amputated. It was a very difficult time for Tina, but she remained patient and helpful throughout.
Ahead of the case’s conclusion, Dale and Ceri obtained a reconstruction report as part of their supporting evidence.
Speaking in conclusion of the case result, Dale said: “The client now has financial security and enough to afford the property she wants and to start her own consultancy business if she wants.”
Despite liability not being agreed, the case settled in January 2019 for a substantial figure.
