Motorcyclist Is Now Focussing On His Future After Receiving £167K in Settlement
In August 2018, our client was travelling along River Way, Harlow, Essex, meanwhile the defendant had just dropped their wife off at work and were pulling out of a driveway of a commercial property. This was the same road our client was travelling along. Whilst turning out of the commercial property’s driveway, the defendant drove across our client’s path. As our client, who was correctly positioned on the road continued his journey, he collided with right side of the defendant’s vehicle.
Due to an impact to our client’s head as a result of the collision, he suffered a period of amnesia and was unable to recall the events of the collision.
Our client suffered the following injuries as a result of the collision:
- Multiple ligament injuries of the left knee,
- Soft tissue injuries on the neck ,
- Multiple left sided rib fractures, ,
- Torn Aorta, which caused a collection of blood between the chest & lungs,
- Bacterial infection in his right forearm,
- Psychological symptoms, by way of moderately severe reactive depression,
- Head injury with post-traumatic amnesia,.
Following the incident, our client required legal support from Fletchers. Solicitor Neil Downey took the case with support from Lauren Phillips and Florence Whitton.
Due to the injuries our client sustained in the collision; our client was unable to return to his usual job after the accident for more than a year. The knee injury he suffered was so severe, that our client required ligament reconstruction surgery. Unfortunately, this surgery was unsuccessful, as a result of which our client will be required to undergo further ligament reconstruction surgery in the future and has suffered an increased risk of developing arthritis of the knee as a result of this collision.
Upon returning to a similar HGV role, our client experienced some difficulties due to the knee injury he had suffered in the collision.
As a result, our client was forced to alter his employment, taking on a different HGV role and needing to retrain as a class 1 HGV driver. This was required in order to reduce the physical demands on his knee and will enable him to continue to work for as long as possible before requiring further surgery on his knee.
The Case Outcome:
Our legal team fought hard to secure a settlement of £167,500, despite liability being disputed throughout the case.
