Over £350K compensation secured in biker-on-biker RTA
A 62-year-old forklift truck driver and warehouse operative was riding his motorcycle around a right-hand bend. Three motorcycles were approaching from the opposite direction when the third motorcycle took a different line of approach from the first two and collided with our client.
Our client suffered multiple injuries including the following:
- Head injury
- Fifth metacarpal fracture of the right hand
- Open segmental fracture of the right femur
- Open fracture of the right tibia
- Weber A fracture – a break to the bone on the outside of the ankle
- Fractured ribs
- PTSD & Major Depressive Disorder
Chartered Legal Executive, Ashley Nolan took on the case, with support from Paralegal, Georgia Catherall. The defendant admitted liability in the months following the collision.
Our client underwent a course of psychological treatment for his psychological symptoms, which included (low mood/mood swings and regular nightmares). The right ankle and knee fractures eventually healed; however, degenerative changes were noted. As a result of his right femur fracture, our client was left with a leg length discrepancy, and input from an orthotist was required. As a result of the right knee fracture, it was likely this would lead to accelerated arthritis development.
Due to the nature of the injuries sustained, our client now has a permanent long-term need for assistance with heavy domestic activities. It’s also possible he will require a knee replacement in later life. Our client is now disadvantaged on the open labour market, with jobs involving manual labour or prolonged standing.
The case outcome
The case was settled with a compensation figure accepted of £358,395.00, which included interim payments.
