Woman awarded £45,000 after another vehicle crossed lanes and collided with her scooter

August 5, 2019

A 34-year-old woman has been awarded £45,000 in a serious injury settlement after her scooter was hit by another vehicle while she travelled home from work.

The claimant, who wishes to remain anonymous, was driving in Erdington, Birmingham, when suddenly and without warning the defendant changed lanes and caused the collision.

The claimant received surgery for a string of injuries that included:

  • Fractures of the Tibial Plateau
  • A fracture to the left Distal Radius
  • A right leg soft tissue injury
  • Scarring and psychological damage following the incident.

Fletchers Solicitors Serious Injury Solicitor, Kirsty Thomas represented the claimant alongside Assistant Litigation Executive, Katie Rutter.

Kirsty said:

“The Claimant clearly had a strong work ethic and sadly, like in most cases, her world was turned upside down after being involved in not one, but two collisions in the space of a few days.

“She had just recovered from the shock of one non-fault accident, only to find herself the victim of a further non-fault accident.

“Sadly the second one was far more traumatic with devastating consequences.

“Nasty injuries followed by the breakdown of her marriage meant that she needed our full support and guidance through such difficult times. She was a pleasure to work for, I wish her all the very best for a brighter future and I am really pleased that her case has now settled.”

As referenced by Kirsty, the Claimant had been involved in another road traffic collision just two days prior.

She had been traveling on a scooter at slow speed when the third party pulled out from a parking space without warning.

Fortunately, she sustained only minor soft tissue injuries but was distressed nonetheless.

Thorough investigations took place to ensure causation was established – linking these severe injuries to the second accident – the accident Fletchers Solicitors represented her on.

Speaking in conclusion to the case, the claimant said:

“For me it is honestly the best company. I felt understood and cared for.”
