Our customer, Samina was left needed to wear specialist bespoke footwear for the rest of her life after doctors failed to provide appropriate bunion treatment.
In 2013, Samina Zaidi from London, was diagnosed with a large bunion on her right foot. She received treatment by way of a bunionectomy and realignment of her big and second toe, on her right foot.
However, in the following months, it was noted that the position of Samina’s toes was not corrected. She needed to undergo revision surgery on her second toe and currently is still awaiting further revision surgery.
It was argued that the type of surgery Samina underwent initially was outdated and not appropriate for the positioning of toes. If Samina had not received negligence treatment, she would have only been required to have one procedure, rather than three.
Due to the issues with her foot, Samina is required to wear bespoke insoles in her shoes; this helps to keep the pressure off her foot. The specialist insoles cost £300 per pair and she will also need to wear bespoke boots, which cost around £1200. She will need to wear these for the rest of her life.
Samina’s contacted Fletchers to bring a medical negligence claim. Her case was hard-fought and liability was denied throughout. The matter was then issued in court and an offer was finally advanced by the Defendant
Kate Lozynska, a medical negligence solicitor, achieved a settlement of £70,000 compensation for Samina. Kate was assisted by medical negligence solicitor Natasha Perkins and said,
It is unfortunate that the Defendant Trust has taken so long to conclude the matter. However, we are pleased that the case has now been settled and Samina’s bespoke footwear costs will be covered for her lifetime.
Following the settlement of her case, Samina thanked Kate for her help and said, “Thank you for all of your help. I’m glad to resolve the matter so that I can try and get my life back together without all this stress.”
