The incident

30-year-old General Assistant in Aviation, Madalina-Diana Stoenescu was travelling as a pillion passenger on her partner’s motorcycle when another vehicle emerged from a side road resulting in a collision.

Following the RTA, our client sustained the following injuries:

• Open fracture of the left knee (requiring open reduction and internal fixation surgery)
• Right knee laceration (requiring open exploration)
• Fracture to her left wrist
• Psychological symptoms
• Scarring and alteration of cosmetic appearance of knees

The case

Miss Stoenescu approached Fletchers for support with the motorbike injury claim. Chartered Legal Executive, Ceri Dudley, was assigned to the case, with assistance from Sarah Ryan – a Serious Injury Assistant Litigation Executive.

The case outcome

Liability in the case was eventually admitted and due to our client’s injuries, she was initially examined by a Consultant Orthopaedic Surgeon, a Consultant Psychiatrist and a Consultant Plastic Surgeon.

Miss Stoenescu continued to suffer with her knee symptoms, because her job role required some physical movement such as lifting and walking around, she was re-examined by the Consultant Orthopaedic Surgeon.

Eventually, and as the independent medical evidence concluded, the Defendant’s solicitors put forward an offer which the client accepted.

Commenting on the case, Ceri Dudley said:

“Madalina sustained nasty injuries as a result of the accident and her recovery has not been straightforward. That being said, Madalina has been nothing short of co-operative throughout the case and has been a pleasure to work for. I wish her all the best for the future.”

In conclusion, Miss Stoenescu added:

“I’m still recovering from the accident, I have been admitted recently to a mental hospital, and they made sure I’m still receiving the right medication for my muscles, after it was discontinued. I still suffer some problems regarding my accident, and I hope one day that I will have less scarring and psychological symptoms.

“I feel I still have post-traumatic stress disorder, and I hope that one day I will be less scared when in the car with my partner. Thank you for all the help.”
