Examples may include a spinal cord injury that causes paralysis, a brain injury that causes some loss of functioning, or an accident that requires the amputation of a limb.

Serious injuries can be caused by medical negligence, an accident at work, a road traffic collision like a motorcycle accident, an injury when taking part in sport or other physical activity, a slip, trip or fall, or severe burns from a fire.

Symptoms brought on by a serious injury vary according to where the injury occurred. For example, the symptoms you experience from a serious brain injury might include difficulty with coordination and balance, and significant changes to your cognitive abilities or personality.

Symptoms of a serious spinal injury may include loss of movement or sensation in your limbs, difficulty breathing or coughing, loss of bowel or bladder control, or extreme back pain or pressure in the neck, head, or back.

Symptoms of a birth injury may include reduced muscle tone and strength (hypotonia), partial or total paralysis of facial muscles, seizures, and developmental delays in milestones such as crawling, walking, or talking.

How are serious injuries treated?

The treatment for serious injuries varies depending on the location and severity of the injury. For example, brain injuries may be treated by emergency surgery to alleviate pressure on the brain, physical and occupational rehabilitation therapy, medication and psychological support.

Spinal injuries may be treated by stabilisation surgery, medication-based pain management, nerve stimulation, physical rehabilitation, and assistive devices like wheelchairs or braces to aid movement.

Birth injuries may be treated by physical therapy to improve muscle function and coordination, surgical procedures to correct physical deformities or nerve damage, and ongoing developmental monitoring and support to address cognitive and physical delays.

Can I claim for a serious injury?

You can claim compensation for a severe injury that has life-changing or long-term consequences on your health and well-being if the accident that caused it was not your fault.

How much time do I have to claim?

There is a statutory time limit of three years after your accident to make a claim. A judge can extend this depending on the circumstances of your injury but there is no guarantee that they’ll do so.

How much does it cost to make a serious injury claim?

Fletchers works on a no-win, no-fee arrangement, sometimes called a “conditional fee arrangement”. If we take on your case, we’re confident we’ll be able to secure the result you want. The average payout for a personal injury claim in the UK can vary widely depending on the severity of the injury, the circumstances of the accident, and other factors such as loss of earnings and future care needs. Generally, compensation amounts can range from a few thousand pounds for minor injuries to several hundred thousand or even millions of pounds for serious injuries

How is compensation calculated for pain and suffering?

The calculation for pain and suffering caused by a serious injury varies according to the location and severity of the injury as well as its long-term impacts.

Although the amount awarded is tailored to the injured person and their individual circumstances, insurers and courts often use the Judicial College Guidelines to help them determine a sum. For example, a severe back injury may attract compensation anywhere from a five to a six-figure sum, depending on the impact it has on the injured person’s life.

Part of this payment reflects the individual’s pain and suffering, sometimes called the “non-economic damage”. You may receive extra compensation on top to reflect your loss of earnings, medical and rehabilitation costs, adaptations to your home and vehicle, and so on.

How long does it take to receive an offer of compensation?

If you’ve suffered a serious injury and you apply for compensation through a solicitor, the claims process can take anywhere from one year, to several years to settle. How long it takes depends on several factors, one of which is how long it takes to gather the relevant information about your injury and the accident to build a strong legal argument.

If your injury was medically complex, it may take time to assess its impact on your life. If you experienced more than one injury in the accident, each injury will need assessing which can delay the process.

Another important factor is whether the defendant accepts full liability for your injury. If there is an argument on liability, it takes time to negotiate how to apportion this fairly. This will prolong the process further, but this is a very rare circumstance.
