Notable Settled Cases

ANON v Local Council

The claimant stepped off a kerb and into a pothole on the edge of the road, breaking both legs. The Council denied liability throughout and maintained that regular inspections had taken place. Upon review of denial documents, these included inspection documents which appeared on face value to show that appropriate inspections had taken place. We then requested records showing when road markings had been painted on that particular stretch of road; as the road markings had been painted into the defect, which caused the Claimant’s accident. These were disclosed and showed that road markings had been repainted prior to the pre-accident inspection and we were able to show that the relevant inspection had not picked up the defect, had not been repaired and ultimately caused the Claimant’s accident.

An elderly couple were involved in a complex road traffic accident. Sadly, there was one fatality and one seriously injured, with multiple physical and psychological injuries. The family were so impacted by the accident, that they struggled to process information regarding the claim and felt unable to deal with the litigation for some time. Despite an initial denial of liability, it was ultimately accepted, and the claim settled prior to a hearing.
