Medical Negligence lawyer Sahida Patel secured over £10 million in compensation for a child who suffered a brain injury at birth at a London NHS Hospital causing dyskinetic cerebral palsy.
The Facts
The Claimant was born on 3 July 2006 in a poor condition and was subsequently diagnosed with dyskinetic cerebral palsy and sadly has problems with walking, speech and learning difficulties. We investigated whether these serious injuries were caused by the negligence of the medical staff.
Our Investigation
The Defendant NHS Trust initially disputed liability for the Claimant’s cerebral palsy brain injuries; however, following a settlement meeting with lawyers for both sides, the NHS Hospital conceded fault for 70% of the Claimant’s brain injuries. The Claimant was accordingly entitled to receive 70% of the total compensation figure eventually agreed with the Defendant.
Settlement
Steps were taken to investigate the extent of the Claimant’s current and future disabilities and needs to determine how much compensation should be paid. It became apparent during Sahida’s quantum investigations (based on the opinions of a Consultant Paediatrician, a Care Expert and an Educational/Clinical Psychologist) that the Claimant was in fact too young to accurately assess and quantify the Claimant’s future prognosis and needs so the claim was stayed for several years (financial support was provided to the Claimant by the Defendant by way of interim payments during this time).
Investigations were started again when the Claimant moved to secondary education. The Court stay of the case was lifting and expert evidence in the following specialised areas was obtained:

At a Joint Settlement Meeting, our team of specialist lawyers managed to agree settlement of the Claimant’s case which, on a capitalised basis, meant that the Claimant secured over £10 million pounds in NHS compensation. A large part of this money will be used to pay for the Claimant’s lifetime commercial care needs (paid on an annual basis); some of it was paid as a lump sum.
