Can I make a spinal injury claim?

You can make a spinal injury compensation claim if your injury occurred because of someone else’s negligence. People often come to us if they have been severely injured in a road traffic collision or an accident at work.

Spinal injury claims can arise when someone owed you a duty of care, breached that duty, and caused your injury. We can help you understand your options. Experiencing a spinal injury is devastating, and we understand the impact it can have on your life.

Our spinal injury solicitors focus on getting you the best possible outcome. We put your needs first, and consider both the immediate impact and the way the injury might affect you in the long-term – from your mobility to your independence, and quality of life.

We have extensive experience in spinal injury compensation claims and complex spinal cord injury claims. We make every decision to support your recovery, future care, and financial security.

We also work on a No Win, No Fee basis. In cases where you are unable to work and financial pressure might be mounting, we believe it’s important to work in this way. Even if you’re unsure if you have a claim, it’s still worth speaking to our specialists.

Example of a spinal injury claim

Imagine a construction worker who falls from unsafe scaffolding while carrying out work at height. He might suffer a serious spinal injury that affects his mobility and ability to return to work.

If proper safety measures were not in place, or the employer failed to follow health and safety regulations, this could be a valid spinal injury claim.

Expertise you can trust

  • 9/10 clients would recommend us
  • Dedicated rehabilitation and wellbeing team
  • Securing interim payments to ensure early access to support

Every claim is different, so the amount of spinal injury compensation you might receive will depend on the specific impact the injury has had on your life. That includes the pain and suffering you’ve experienced, and also the long-term effect on your independence, work, finances, and day-to-day life.

When valuing a spinal injury claim, a number of factors are considered:

  • The severity of the injury
  • Your age and future prognosis
  • The level of care and support you need
  • Loss of earnings and other financial losses
What compensation can provide

We achieved a seven-figure settlement for Ian, which provided him with long-term security, specialist rehabilitation, and a future-focused care plan. This allowed Ian to return to cycling using a hand bike and complete a 100km ride around Yorkshire.

Every claim is different, and the amount of spinal injury compensation you receive depends on your circumstances. We consider the severity of your injury, your age and future earning potential, your ability to work and the level of care you need long-term.

In the most serious cases involving paralysis, compensation for a spinal cord injury can reach six- or seven-figure settlements.

Understanding interim payments

You shouldn’t have to wait until the end of the spinal injury claims process to get the support you need. We know that serious injury cases can place real financial pressures on you and your family.

Where possible, we’ll look to secure interim payments on your behalf. In some cases, this can help you access rehabilitation and specialist equipment much sooner than you otherwise could.

You're not alone

A spinal injury changes far more than your physical health.

For many people, suffering a spinal injury affects every part of daily life. Simple things that once felt routine can suddenly become difficult or impossible. Adjusting to those changes can be physically exhausting and emotionally overwhelming, not just for you, but for the people closest to you as well.

We understand that you might be unsure about starting a spinal injury claim. Often, there can be a feeling of uncertainty as to how the injury was caused, or whether there was negligence at play. Our specialist team can help you to understand this and will outline the many ways that a compensation claim can support your recovery.

We’ve supported many people living with life-changing spinal injuries, including clients who initially felt unsure about where to turn or whether anyone would truly understand what they were going through. What they needed was a team who would listen, understand the realities of life after a serious injury, and help them take back a sense of control.

FAQs about spinal injury claims

What should I do after an accident that causes a spinal injury?

If you or a loved one has suffered a spinal cord injury in an accident, your health and recovery need to come first. Seek medical attention as soon as possible and follow the advice of the professionals treating you.

If you’re able to, there are some steps you can take to support any potential spinal injury compensation claim:

  • Keep records of your medical treatment, appointments, and rehabilitation
  • Take photographs of the accident scene and your injuries, where possible
  • Keep contact details for any witnesses
  • Report the accident to the relevant person or organisation, such as your employer
  • Keep receipts and a record of expenses, lost earnings, and additional care needs
  • Speak to a specialist spinal injury solicitor to understand your options

We understand that gathering evidence may not be possible when you’re recovering from a life-changing injury. Our spinal cord injury solicitors can help you through the process, taking on the legal work so you can focus on recovery.

What is the spinal injury claims process?

Making a spinal injury compensation claim can feel overwhelming, particularly when you’re also dealing with the physical and emotional impact of your injury. Our specialist solicitors will walk you through every stage of the process and explain what to expect.

1. Initial assessment

We will listen to what happened, discuss your injury in detail, and explain whether you may be able to make a spinal injury claim.

2. Investigation & evidence gathering

We’ll investigate how the accident happened and gather evidence to help establish who was responsible and the role they played in your accident.

3. Assessing your needs

Our team will work with medical and rehabilitation experts to understand how your spinal injury affects your mobility, independence, and long-term care requirements. This will help us negotiate a settlement that truly reflects your injury and its impact.

4. Compensation

Your solicitor will negotiate with the responsible party or insurer to secure a fair settlement. Where possible, we’ll also look to secure interim payments while your claim progresses.

Many spinal injury claims are settled without going to court. However, if court proceedings are necessary, our solicitors can represent you and guide you through the process.

How long do I have to make a spinal injury claim?

For most serious injury cases in England and Wales, you have three years from the date of the accident to start court proceedings for a spinal injury claim. If your injury wasn’t immediately linked to a specific incident, the three-year period may run from the date you first made that connection, known as your date of knowledge.

There are also important exceptions, such as if you were under 18 at the time of the accident. In this case, the three-year limit typically begins on your 18th birthday, giving you until your 21st birthday to make a claim. If a lack of mental capacity has affected your ability to claim, different time limits may apply.

Whatever your situation, we’d always encourage you to get in touch as soon as possible. Acting early means we can gather the strongest possible evidence and give your case the best chance of success.

How long does a spinal cord injury claim take?

Spinal injury claims are among the most complex cases in personal injury law, and it’s important to have realistic expectations about timescales from the outset.

Many cases take several years to resolve, particularly where the full extent of a person’s long-term needs is still emerging, liability is disputed, or expert medical evidence needs to be gathered and reviewed.

We know that’s a long time to wait, and we’ll make sure you’re never left in the dark about where things stand. Our spinal injury claims solicitors will keep you updated at every stage, and we’ll work to secure interim payments wherever possible so you can access the care and support you need while your claim progresses.

Why pursue a spinal injury compensation claim?

Pursuing a spinal cord injury claim means you have the opportunity to seek financial compensation. Compensation for a spinal cord injury will support your recovery in the short term and account for any additional care you may need in the long term.

Compensation can cover:

  • Loss of earnings and pension
  • Specialist care and rehabilitation
  • Mobility aids and home adaptations
  • Pain, suffering, and loss of quality of life
  • Miscellaneous expenses like travel costs for medical appointments

We understand that experiencing a spinal cord injury is life-changing, not only for the individual affected, but also the wider support network. Our spinal cord solicitors are experienced in managing complex spine injury cases, and have settled hundreds of spinal injury claims in our clients’ favour.

Regardless of how your injury occurred, our team of spinal cord injury lawyers can support you to rebuild your life.

How much compensation could I get in a spinal injury claim?

How much compensation for a spinal injury you receive depends on several factors. While it isn’t possible to give an exact figure at the outset, the Judicial College Guidelines provide compensation brackets for different types of spinal injuries. These guidelines help shape the value of general damages – compensation awarded for the pain, suffering, and impact the injury has had on your quality of life.

Your spinal cord injury compensation claim may also include special damages. These are designed to cover the financial consequences of your injury, both now and in the future. Depending on your circumstances, this can include loss of income, rehabilitation costs, specialist equipment, home adaptations, ongoing care, and other expenses linked to your recovery.

Despite returning to work, he faces ongoing physical challenges and future surgery. Liability was fully admitted, and the settlement will help with his recovery.

  • Photographs

  • Accident reports
  • CCTV or other footage
  • Independent medical assessments
  • Prosthetic assessments

Can I claim compensation if the spinal injury was partially my fault?

You may still be able to claim compensation if you were partly responsible for your accident that led to your spinal injury. In these situations, your compensation may be reduced to reflect your share of responsibility. This is known as contributory negligence.

I firmly believe that every person deserves to feel supported, heard and understood after a serious injury, the legal process can feel overwhelming at a time when someone’s life has been turned upside down. Ensuring they feel guided, informed and supported from the very first meeting and throughout the case is equally as important as securing the right outcome.
