Can I make a meningitis compensation claim?

A meningitis compensation claim can be made when a failure by medical professionals - such as a delayed diagnosis, misdiagnosis, or failure to carry out appropriate tests - directly caused you or your child to suffer serious harm.

Meningitis is a fast-moving condition, and when it’s caught and treated promptly, life-threatening complications can often be avoided. When that doesn’t happen, the consequences can be devastating and life-changing.

People come to us for support when a doctor or healthcare professional fails to recognise the symptoms of meningitis, delays ordering the right tests, misdiagnoses the condition, or fails to start treatment quickly enough. This can apply whether the meningitis was bacterial, viral, or meningococcal septicaemia – all of which require urgent medical attention.

To have a valid claim, we need to show that the failures of the medical team were directly responsible for the harm you or your child suffered. But you don’t need to be certain this is the case before speaking to us. If you have concerns, we can help you make sense of things.

Meningitis negligence can be a devastating experience. In the immediate aftermath, you’re likely to be dealing with a lot of physical and emotional challenges – so you may not consider making a claim until much later. In most cases, you have three years to make a claim. There are exceptions to this, particularly where a child is involved. So, we’ll advise you clearly on the time limits that apply to your situation.

Example of a meningitis compensation claim

Imagine a child is taken to A&E with a severe headache, fever, stiff neck and sensitivity to light. The attending doctor attributes the symptoms to a viral infection and sends the family home without testing for meningitis. Over the following hours the child’s condition deteriorates rapidly, and bacterial meningitis is eventually diagnosed – but only after a significant delay. If earlier testing and treatment could have prevented the serious harm that followed, this could form the basis of a valid meningitis negligence claim.

What compensation can help with

Close-up of two people holding hands gently
Funding the care, support and recovery you and your family need.

Meningitis can leave lasting physical effects, including limb loss, hearing loss, brain damage, and significant cognitive and developmental difficulties. The financial impact – from lost earnings and specialist equipment to ongoing therapy and care needs – can be profound.

For children, compensation can be particularly important in securing long-term support as they grow and their needs change. For adults, it can help restore some financial stability and fund the rehabilitation needed to return to as full a life as possible. Compensation will reflect the full picture, not just the immediate aftermath.

A successful meningitis compensation claim may help fund:

  • Rehabilitation, physiotherapy and occupational therapy
  • Specialist medical treatment and ongoing healthcare
  • Psychological support and counselling for you and your family
  • Prosthetics and specialist equipment where limb loss has occurred
  • Home adaptations and mobility aids
  • Loss of earnings, including future loss of income
  • Care and support needs, both immediate and long-term
Understanding the potential value

We have secured some significant settlements in meningitis negligence cases. We secured a £10.5 million settlement for a person more than 10 years after a delay in diagnosing bacterial meningitis caused life-changing harm. In another case, our client received £900,000 following a delayed diagnosis of Listeria meningitis. These figures reflect the serious, long-term impact these cases can have – and our commitment to pursuing fair outcomes. The value of a meningitis compensation claim depends on the severity of the harm suffered, the long-term impact on health and quality of life. Compensation is there to give you and your family the financial security to access the right care, rebuild your lives, and plan for the future – whether that’s weeks, months, or many years from now.

Understanding interim payments

You shouldn’t have to choose between getting the support you need now and pursuing the compensation you deserve. We understand that the financial pressure of a serious illness can begin long before a case is resolved. Where it’s possible, we’ll apply for interim payments on your behalf – payments made during the meningitis claims process, before final settlement is reached. These can help fund immediate care, rehabilitation, specialist equipment or home adaptations without waiting for the full claim to conclude.

You're not alone

We understand the challenges you're facing.

We know that living with the effects of meningitis – or supporting a child or loved one who does – affects you deeply. The physical impact can be severe and lasting. People can suffer hearing loss, limb loss, brain damage and developmental difficulties. But beyond the physical, many people also carry the weight of uncertainty and grief. There may be questions about why this happened and whether it could have been prevented. Those questions deserve answers.

Many of our clients came to us unsure whether they had a claim, or whether they had the strength to pursue one. We understand this, and we know that the prospect of bringing a claim forward can feel heavy. But often, securing compensation after a meningitis negligence can be a positive first step in the recovery process.

Compensation can help cover the lost income you’ve suffered, and fund any specialist care, equipment, and therapies you now need. We want to help you get to this outcome. We’ll handle every part of the process, keep you informed at every stage, and pursue the compensation that truly reflects the impact of what has happened to you and your family.

FAQs about meningitis compensation claims

What causes meningitis?

Bacterial meningitis can occur when bacteria enters the body via the nose or mouth. In most cases these bacteria live in the body without causing harm. Sometimes – for reasons not yet fully understood – the bacteria cross into the bloodstream and cause widespread harm. Symptoms can include:

  • Severe headache
  • Vomiting
  • Aching joints
  • Fever
  • Stiff neck
  • Aversion to light
  • A purple rash that does not fade when a glass is pressed against it

Some of these symptoms can be associated with less serious illnesses like flu. However, where there is a real possibility of meningitis, doctors should act urgently – ordering appropriate tests and beginning treatment without delay. Speed is vital, as meningitis can progress and cause serious harm within hours.

When can I make a meningitis negligence claim?

You can make a meningitis negligence claim if you or your child were misdiagnosed, your diagnosis was delayed, or appropriate treatment was not given in time. The key question is whether a failure by medical professionals directly caused the harm suffered.

In most cases there is a three-year time limit from the date of the incident – or from when you became aware that negligence may have contributed to the harm. Where the claim involves a child, different rules apply. We’ll always advise you clearly on the time limits relevant to your situation, so please don’t assume you’ve left it too late without speaking to us first.

How long do I have to make a meningitis claim?

There is a statutory time limit of three years from the date of the incident in which to bring a claim. There are exceptions to this – for example, where the person affected is a child, or where it took time for the link between negligence and harm to become apparent. Please speak to us as soon as possible so we can advise on the specific time limits that apply to you.

How much does it cost to make a meningitis claim?

Fletchers operates on a No Win, No Fee basis – sometimes called a conditional fee arrangement. This means you’ll not pay us anything if we don’t secure compensation for you. If your case is successful, our success fee is taken from the final settlement amount and will be clearly explained to you throughout the process.

Depending on your circumstances, you may also need after-the-event (ATE) insurance before we progress your case. We’ll discuss this with you clearly before any costs are incurred.

What evidence is needed for a meningitis claim?

Once your claim is accepted, your solicitor will gather the evidence needed to support your case. This typically includes:

  • Medical records relating to the diagnosis and treatment of your meningitis
  • Independent expert medical evidence from specialists in the relevant field
  • Personal impact statements describing how your life has been affected
  • Financial loss information, including lost earnings, care costs, and other expenses

You don’t need to gather this evidence yourself – we’ll handle that process on your behalf.

What support is offered during my meningitis claim?

From the first conversation, our priority is your health and wellbeing – not just the legal process. We’ll explain things clearly, keep you informed at every stage, and work to make the process as straightforward as possible.

Where appropriate, we’ll also look to secure interim payments to help fund care, rehabilitation, or specialist equipment while your claim is ongoing. Our aim is to make sure you have access to the support you need as early as possible – not just at the end of the process.

When is meningitis negligent?

Medical professionals may be negligent by failing to carry out the appropriate tests, misdiagnosing the condition or not making a timely enough diagnosis. In these circumstances there may be a case for making a claim if you or your child suffers harm as a consequence.
