£1.3m settlement achieved for client who suffered life-changing injuries in RTA

The Incident  

On 5th December 2019, our client was unfortunately involved in a road traffic accident. They were travelling along the road whilst riding his motorcycle when the defendant’s car emerged from a side road to our client’s left. They went into the path of our client’s established motorcycle, resulting in a collision. On impact, our client was unfortunately thrown over the bonnet of the defendant’s vehicle and landed in a nearby hedgerow.  

The Aftermath 

The emergency services arrived at the scene and transported our client by Ambulance to Sheffield Northern General Hospital. Our client was successfully resuscitated and transferred to the High Dependency Unit (HDU), where he remained for 3 days. After a series of trauma investigations, including x-rays and scans, the extent of our client’s injuries was revealed.  

As a result of the collision, our client suffered multiple injuries which include the following: – 

  • Traumatic brain injury with small haemorrhage. 
  • Two fractured ribs. 
  • Internal bleeding in their upper abdomen. 
  • Multiple ligament injury to their right knee. 
  • Fracture of their pelvis. 

During his admission, he had to have 2 procedures on his right-knee and pelvic surgery. Our client’s recovery following this life-altering accident has been long and protracted and he is unfortunately not expected to ever recover fully.  

Our client is now left with significant levels of fatigue, as well as impaired cognitive function. He requires round-the-clock care and assistance. As a result, he was unable to return to work as an Operations Supervisor.  

Our client has also suffered significant levels of psychological disturbance due to the accident impacting many aspects of his life such as relationships with family and friends. They unfortunately suffered traumatic thoughts, flashback imagery and nightmares of the accident. 

The Case 

A Fletchers Chartered Legal Executive, took on the case. Following receipt of our allegation’s liability was denied by the defendants. They argued that there was contributory negligence due to our client’s speed and argued that our client failed to wear the appropriate clothing. 

The case eventually settled without any concessions on liability.  

The Case Outcome 

Our client’s case was settled for £1.3 million on 6th December 2023. This also included provisional damages relating to uncontrollable epilepsy up to 2039 i.e. 20 years post-accident. This is a significant amount that will help our client and his family in a remarkable way.  

This money will allow his family take care of him on his road to recovery. Although it is unlikely that our client will be able to ride his motorcycle again, he will be able to put this money towards his new car. 

Our client is currently volunteering at an animal sanctuary however hopes to return to work. The money he was awarded will also allow him to increase his mobility and reduce his pain with the help of his healthcare providers.
