ROAD TRAFFIC ACCIDENT

Cyclist Injured in Country Road Collision Secures £13,000 Compensation

Our 59-year-old client was cycling with two friends along a quiet country road when their ride was unexpectedly disrupted by a motorist travelling on the wrong side of the road.

The three cyclists were riding in single file. As the car came around a corner at speed, the lead cyclist veered into a ditch to avoid a collision. Unfortunately, the second cyclist was struck by the vehicle (who has an ongoing claim with Fletchers), and our client, who was riding at the rear, was also involved in the incident. He could not confirm whether he collided with the middle rider or was hit by the car himself, but the impact caused multiple injuries.

The injuries and recovery

As a result of the collision, our client sustained several soft tissue injuries and scarring to his leg. He also experienced psychological distress, particularly after returning to cycling. He reported anxiety around passing vehicles and difficulty regaining confidence on the road.

In the weeks following the accident, he needed between two and three weeks to recover.

The legal case

Our client contacted Fletchers Solicitors, and his case was managed by experienced Chartered Legal Executive Nina Haddock.

At first, the third party denied responsibility, alleging the cyclists were riding three abreast. This was disputed by all members of the cycling group. A crucial witness statement from the lead cyclist, a retired police inspector, supported the claim that the group had been riding in single file and that the vehicle had been driving too fast for the conditions and crossed into their lane.

Despite submitting medical and expert evidence, the defendant made no offer, so proceedings were issued. After court action began, the defendant made an initial offer of £10,000. However, based on the injuries and impact on the client’s life, Nina judged this to be too low.

She responded with a Part 36 offer of £13,000, which was accepted shortly afterwards.

A fair outcome

The settlement reflects the pain, disruption, and financial impact the collision had on our client. It has helped cover lost earnings, support ongoing recovery, and provide some closure following a challenging experience.

“Nina’s work has been fantastic. I didn’t really think that I would get anything as a result of my accident. It’s only due to Fletchers’ intervention that I’ve ended up with the damages. Nina has been brilliant.”
