Lifelong security secured in £20million settlement for child left severely disabled after delayed diagnosis of GBS meningitis

A young boy, Timothy (not his real name due to an anonymity order), will now receive lifelong support and care after Fletchers Solicitors secured a significant settlement following a devastating delay in the diagnosis and treatment of Group B Streptococcal (GBS) meningitis resulted in a profound brain injury causing cerebral palsy.

The settlement, approved this week at the Royal Courts of Justice, ensures that Timothy’s complex needs will be met for life – providing his family with the reassurance that he will always have access to the care, therapies, accommodation and equipment he requires.

What happened in this case?

When Timothy developed jaundice in the days following his birth in February 2017, his community midwife failed to refer him back to hospital for treatment and tests that would have identified an infection, resulting in urgent antibiotic treatment. As a result, Timothy’s infection developed into meningitis and sepsis, leading to a profound and avoidable brain injury causing severe four-limb cerebral palsy, visual and intellectual impairment, epilepsy and feeding difficulties.

The legal journey

Our Birth Injury specialists, led the case on behalf of Timothy and his family. We meticulously gathered evidence from a number of medico-legal experts including a midwife, a general paediatrician, a neuroradiologist and a paediatric neurologist.  The Defendant NHS Trust initially denied liability. This resulted in us taking them to Court to fight the case for our client. After disclosure of key evidence – including family photographs and video footage taken shortly after Timothy’s birth – the Trust admitted full responsibility for the negligent delay in diagnosis and treatment.

A settlement focused on lifelong care

Following the admission, we were able to secure an interim payment to take care of some of the more immediate requirements for Timothy. The team at Fletchers worked with a wide range of medical and care experts to assess Timothy’s needs. The final settlement -valued at a capitalised amount of approximately £20 million – provides both a lump sum and annual, index-linked periodical payments to cover Timothy’s lifelong care, private therapies (including physiotherapy, occupational therapy, speech and language therapy, music therapy, psychology etc), specialist equipment, adapted housing and case management support.

The settlement  ensures that Timothy can live safely and comfortably in his own adapted home, supported by a dedicated team and he will be able to pursue the activities that bring him joy, including music and water-based therapies.

The legal journey was not without its challenges. The Defendant disputed some key areas of the quantum claim (particularly hydrotherapy, music therapy, equipment, holidays and future private therapy provision) which we believe were important to Timothy’s future needs. Our team of legal experts very carefully evidenced why these specific needs were so important for Timothy and after significant negotiations we were able to agree a compromise figure.
