Walsall Healthcare NHS Trust Report on Mian Shah: A Step Forward, but Scope Falls Short

Key Findings of the Report
The report investigates Mr. Shah’s clinical practice between 2004 and 2021, when he was suspended. It outlines the reasons for the scrutiny of his work and the steps taken by the Trust to assess the extent of patient harm resulting from his treatment. However, due to limited patient records, the review only covers cases from 2010 onwards. During this period, Mr. Shah treated 7,578 patients, of whom 382 underwent procedures later identified as concerning. These included:
- Shoulder replacement surgeries:
- Total shoulder replacement
- Reverse shoulder replacement
- Shoulder hemiarthroplasty
- Humeral resurfacing procedures
- “Latarjet” procedures for recurrent shoulder dislocations
- Elbow joint replacement
- Hand and wrist surgeries involving fusion or bone grafting
The report confirms that these procedures, when conducted by Mr Shah, had exceptionally high complication rates and that the level of patient harm was significant.
Concerns Over Scope and Governance Failures
Despite acknowledging serious patient harm, the report is limited in it’s scope. By reviewing only a subset of affected patients does not provide a full picture of the widespread impact of Mr. Shah’s surgical practice. We would have liked to have seen a more extensive investigation covering all of the patients who he performed surgery on in order to fully understand the extent of harm caused.
One of the most alarming revelations from the report is the lack of oversight that allowed Mr. Shah to expand his role into highly specialised and complex upper limb surgeries without appropriate governance. The report states:
“It seems that governance processes, outcome data, and some aspects of departmental organisation were not sufficiently robust to prevent this ‘mission creep’ in terms of scope of practice or to oversee that it was being undertaken safely.”
For our clients, this will be deeply concerning. Many were treated by Mr. Shah at a time when concerns should have been identified and acted upon by those managing him.
A Need for Change
While Mr. Shah’s actions cannot be undone, the report does highlight critical recommendations aimed at preventing such failures in the future. These include:
- Improved ongoing auditing of surgical outcomes
- Ensuring consultants do not work in isolation
- Mandatory Multi-Disciplinary Team (MDT) approval for certain procedures
- Enhanced record-keeping and procedural oversight
While these measures are important, they mirror recommendations from other patient recalls across the country. The fact that similar governance failures continue to occur suggests a systemic issue that extends beyond Walsall Healthcare NHS Trust.
