8 figure settlement for a young girl with catastrophic brain injury

The Claimant, then aged 6, suffered a catastrophic brain injury as a result of being hit by a vehicle while running across the road.

The Claimant remained in hospital for five months after the accident before moving to the specialist Tadworth Rehabilitation Hospital in Surrey for further rehabilitation.

The Claimant experienced ongoing physical difficulties and cognitive impairment as a result of her injuries.

For a period of time she relied on PEG feeding, although she eventually regained the ability to feed herself independently.

She initially attended a mainstream school but was expected to require more specialist support at secondary level.

Although her injuries were life-changing, the Claimant made very good progress following early intensive rehabilitation.

Liability was contested and the case was due to proceed to a split trial on liability at the High Court in London.

Accident reconstruction and neurosurgical evidence was commissioned to investigate liability.

Damian Horan and the team also obtained evidence from experts in neurorehabilitation, educational psychology, physiotherapy, care, occupational therapy, and speech and language therapy.

This evidence allowed the team to properly assess the value of the claim and respond to any settlement offers made by the Defendant.

The matter proceeded to mediation before the liability trial took place.

Although the Defendant made no concession on liability, they eventually became willing to negotiate a financial settlement.

Damian Horan secured a settlement of £11.75 million, which was later approved by the High Court in London as being in the Claimant’s best interests.
