£3,000 settlement for knee injury caused by broken drainage pipe
The incident
While crossing a busy road to reach a restaurant, our client stepped between two parked cars, a common scenario on that road during the evening. As he mounted the pavement, his foot caught on a broken drainage pipe protruding from the kerb, causing him to fall and sustain injuries.
Injuries sustained and impact on life
The fall resulted in an acute soft tissue musculoligamentous sprain in his left knee, with a prognosis period of six to nine months. Although our client had a pre-existing injury that caused thickening of the tendon, the accident aggravated his condition.
A passionate footballer before the incident, our client found himself unable to play as frequently as before, leading to frustration and a sense of loss.
The case and outcome
Initially, the defendant denied liability. However, during disclosure, it was evident that they had failed to inspect the specific accident location and had mistakenly raised a repair in the wrong area. Consequently, they admitted liability.
After reviewing the client’s medical and financial evidence, the defendant made an initial Part 36 offer of £2,750. Through expert negotiation by Litigation Executive Justine Murtagh, the offer was increased to £3,000, which our client accepted.

£13,000 secured a raised paving slab resulted in injury
The incident
While walking home from the shop with his son, our client tripped on a raised paving slab and fell, sustaining multiple injuries. The incident was both physically painful and emotionally distressing for the client and his family.
Injuries sustained
- Bruising and a cut to the bridge of the nose, leaving a permanent scar
- Soft tissue contusions to the left shoulder and wrist
- Grazing to the right hand
- Bruising to the left arm and chest
A Plastic Surgeon advised that the nasal scar would be permanent, with minimal options for improvement beyond camouflage makeup or medical tattooing. The visible scar served as a constant reminder of the accident, affecting our client’s confidence and emotional well-being.
The case and outcome
The third-party insurer initially denied liability and failed to provide the requested disclosure. Our team submitted a pre-action disclosure application, and Litigation Exeuctive Justine Murtagh attended the hearing. Unprepared for the hearing, the defendant requested a new date, which the Judge granted.
Before the rescheduled hearing, the defendant supplied the missing information. Once we received the final medical evidence, we issued the claim. Our team made Part 36 offers for both liability and quantum. The defendant accepted our 100% quantum offer of £13,000, bringing the case to a successful conclusion without the need for a trial.
The client and his family were relieved to reach a settlement, knowing that the compensation would help them move forward after the distressing experience.
Client receives £3,000 after manhole incident
The incident
While standing outside his rental property, our client stepped onto a manhole cover that unexpectedly sank and shifted, causing his leg to slip into the opening. The incident left both physical and emotional scars.

Although the physical injury was relatively minor, the psychological impact was significant. The client developed a fear of stepping on manhole covers, experiencing anxiety whenever one moved beneath his feet.
The case and outcome
The defendant denied liability. After receiving medical evidence, Litigation Executive Justine Murtagh sought counsel’s advice. Due to the lack of notice—a crucial factor in establishing a claim—counsel advised that the prospects of success did not exceed 51%.
Despite this challenge, Justine proposed a 50/50 liability claim with a net quantum offer of £2,500. The defendant responded with a higher offer of £3,000, exceeding our liability and gross offer. Our client was delighted with this outcome, which allowed the case to conclude successfully without further litigation.
