What are the common causes of brain injury claims?

  • Slips, trips and falls: Slipping or tripping over can lead to brain injuries. This could be a workplace accident or an accident that occurs in a public space.
  • Road traffic accident: Pedestrians, as well as people involved in motorcycle accidents and cycling accidents are particularly vulnerable to severe head trauma.
  • Sports injuries: Sports, including football, basketball, cycling, swimming and skateboarding, can lead to severe head injuries as well as spinal injuries
  • Medical negligence: Despite their very best efforts, medical professionals make mistakes and don’t always deliver the standard of care patients are entitled to. Brain injuries can occur during surgery and to babies during or after childbirth. Sometimes, doctors and consultants miss conditions that might lead to a stroke or other acquired brain injury.
  • Violence: Assaults and domestic violence are the causes of many traumatic brain injuries in the UK.
  • Explosions and combat: Members of the Army, Navy and Air Force are at risk of brain injuries because they and the vehicles they travel in may be subject to explosions and blasts in combat or training.

Brain injury cases

  • Janice: Janice experienced a brain injury after being thrown from her motorcycle in a road traffic accident. This caused her problems with walking, vision and memory.

The compensation we secured for Janice has greatly helped her recovery, opening up new opportunities for her, including giving her the confidence to take up ballroom dancing.

  • Les: Les was in a coma for three months in a road traffic accident. His brother, Paul, approached us to see if Les had a case for compensation for his brain injury. After examining the evidence, we believed that Les had a very strong case.

Now, following the payment of his compensation award, our Court of Protection team is in regular touch with Les. They have helped move him into an adapted home where he can live comfortably, securing his long-term future.

Brain Injury Claims – Frequently Asked Questions

What is the most serious type of brain injury?

What qualifies as a traumatic brain injury?

A traumatic brain injury (TBI) is caused by an external force such as a blow, jolt, or bump to the head where the skull is pierced which may lead to disruption in the normal function of the brain. This can occur during accidents at work, road traffic incidents, falls, sports injuries, or assaults. They can also occur during surgery.

What are the four types of traumatic brain injury?

  • Concussions: With a concussion, the brain moves rapidly inside the skull, and that can lead to damage to brain tissues and blood vessels.
  • Penetrating brain injuries: These describe injuries where an object breaks the skull and goes into the brain itself. This is particularly serious and can lead to strokes, cell death, bleeding and other complications.
  • Anoxic brain injuries: These result from a lack of oxygen to the brain. This can kill your brain cells within minutes and is sometimes caused by drowning or trauma to your blood vessels.
  • Diffuse Axonal Injuries (DAI): These occur when connecting fibres tear away from the brain. They can lead to widespread brain damage.
