Can I make a hydrocephalus claim?

Hydrocephalus is a build-up of fluid in the brain that can increase pressure and can cause serious, lasting damage if not treated appropriately. When healthcare professionals fail to act, the consequences can be profound and lifelong. You may be able to make a hydrocephalus claim if your child’s condition was the result of substandard medical care.

Negligence can contribute to congenital hydrocephalus in a number of scenarios. We typically see families come to us when there has been a delayed diagnosis, a failure to monitor symptoms or changes in your child’s condition, a failure to act on signs of increased pressure on the brain, or delays in surgical intervention or other necessary treatment. In some cases, a failure to escalate care – for example, not referring to a specialist when symptoms become worse – can also form the basis of a claim.

Signs of congenital hydrocephalus in babies include; an unusually large head, visible veins in the scalp, a bulging or tense ‘soft spot’ on the baby’s head and downward looking eyes. It can also contribute to poor feeding, irritability, vomiting, sleepiness and muscle stiffness or spasms. Even if you are unsure if you have a hydrocephalus negligence case, our team can advise you. Claims are usually pursued by parents or legal guardians who are looking for answers, and some assurance, for their child’s future.

Example of a hydrocephalus claim

A previously well baby might start to show signs of distress in early development. The baby might appear jittery, with feeding regression and vomiting. The mother might raise these concerns with her GP, who might dismiss the symptoms as no cause for concern. If the mother later notices an increase in the symptoms, alongside a visible increase in the size of the baby’s head, the GP should consider all of these symptoms together, and review for possible hydrocephalus. Failure to escalate for surgical intervention could increase pressure on the brain, and may contribute to irreversible brain damage.

What compensation can help with

Securing the financial support your child needs to thrive.

Hydrocephalus compensation claims are often significant due to the long-term impact on the child’s life. Hydrocephalus can affect your child’s development, mobility, communication and independence. In some cases, hydrocephalus can be fatal. Compensation is reflective of the pain, loss and suffering that families affected by hydrocephalus are likely to face – both now and in the future.

A successful hydrocephalus claims can support your child’s ongoing and future needs, by covering:

  • Lifetime care and support costs
  • Therapy and rehabilitation, including physiotherapy, occupational therapy and speech and language therapy
  • Specialist equipment and mobility aids
  • Adapted housing or home modifications
  • Specialist education and learning support
  • Psychological support for your child and family
  • Loss of earnings where a parent needs to reduce or give up work to provide care
Understanding the potential value

Because the impact is often severe, and the family’s lifelong needs are likely to be substantial, hydrocephalus compensation claims can often reach six figure settlements. We work with medical and care experts to gain a detailed understanding of your personal circumstances, so that we can build a strong case that supports your family’s needs. We consider loss of earnings – both now and in the future – which is important when parents have to give up work to look after their child. We also consider treatment costs, the costs of specialist equipment, and rehabilitation funding. The value of a claim depends on the severity of the injury, the level of care required, and the wider effect on your family’s future.

Understanding interim payments

Learning to adjust to life after a serious hydrocephalus diagnosis can be extremely challenging. The reality of attending medical appointments, seeking specialist care, and having to step away from work to take on care responsibilities, can quickly start to increase financial pressure. Where appropriate, we will seek interim payments during the course of your hydrocephalus claim. This often means that families are able to access the specialist care, treatment and support your child needs right now – which can make a real difference to the overall wellbeing and emotional balance within the family.

FAQs about hydrocephalus claims

Can I claim for hydrocephalus caused by medical negligence?

Yes. If your child’s condition – or the harm caused by it – was the result of failures in diagnosis, monitoring, or treatment, you may be able to make a claim. A specialist solicitor can help you understand whether what happened amounts to negligence and whether you have a case worth pursuing.

What is hydrocephalus?

Hydrocephalus is a build-up of cerebrospinal fluid in the brain that increases pressure on brain tissue. If not identified and treated promptly, it can cause serious and lasting brain damage. Symptoms in babies and young children can include rapid head growth, persistent vomiting, drowsiness, irritability, spasms, and downward looking eyes.

How do I prove that negligence caused my child's hydrocephalus?

To succeed in a claim, you need to show two things: first, that medical professionals failed to provide the standard of care that could reasonably be expected; and second, that this failure directly caused harm to your child. We will obtain your child’s medical records, instruct independent medical experts to assess the care provided, and build the evidence needed to establish both of these elements. You do not need to gather this evidence yourself – that is our job.

How much compensation can I claim for hydrocephalus?

Compensation depends on the severity of your child’s injury and the level of care and support they will need throughout their life. Because hydrocephalus can have a significant long-term impact, claims are often substantial – reflecting lifetime care costs, therapy, specialist equipment, adapted housing, specialist education, and the wider impact on your family. Every case is different, and we will work with medical and care experts to ensure the compensation claimed truly reflects your child’s needs.

How long do hydrocephalus claims take?

These claims are complex and can take time to resolve – particularly where the full extent of your child’s needs must be carefully assessed. Your solicitor will work to progress the case as efficiently as possible, while making sure nothing is rushed that might affect the outcome. In the meantime, we will seek interim payments where possible so that support does not have to wait.

How long do I have to make a claim?

In most cases involving children, you have until your child’s 21st birthday to bring a claim. However, we strongly recommend seeking advice as early as possible – evidence is easier to gather and expert recollections are fresher. If you are in any doubt about timing, speak to a specialist solicitor as soon as you can.

Will I need to go to court?

Most hydrocephalus claims are settled out of court through negotiation. However, if a fair settlement cannot be reached, we will not hesitate to take your case to court and will support you fully throughout that process.

Do I need to pay anything upfront?

No. We handle hydrocephalus claims on a No Win No Fee basis, which means you do not pay unless your claim is successful. There is no financial risk to you in pursuing a claim.
