Supporting patients to bring vaginal mesh claims against NHS trusts and private surgeons

Vaginal Mesh Claims

The expert medical negligence team at Fletchers is supporting dozens of patients who have suffered severe pain and discomfort following negligent treatment using vaginal mesh implants.

Vaginal mesh implants have been widely used to treat conditions such as pelvic organ prolapse and urinary incontinence. They have been regularly used as a surgical tool across the country for many years, but in some cases the vaginal mesh has been inserted incorrectly or used inappropriately causing permanent damage.

Some complications caused because of negligence include urinary retention, bladder infections, pain during intercourse, bleeding and incontinence, amongst others. The consequences for women having to live with these symptoms can be devastating.

In 2022, an independent review led to the decision for the use of vaginal mesh implants to be paused. However, it is estimated that more than 100,000 UK women have already had a mesh fitted.

The medical negligence team at Fletchers, have represented many patients who have reported life changing injuries following the use of mesh in a gynaecological procedures.

The team has already successfully settled claims against both NHS trusts and private surgeons, securing compensation and an apology on behalf of their clients.

Further to the news that the West Sussex law firm Fortitude Law has shut down, the firm is also offering advice to individuals who are concerned about their available options.

If you or a loved one has experienced complications following treatment involving vaginal mesh products such as TVT or TOT and have been affected by the closure of Fortitude Law, please speak to our team for a free, no-obligation consultation today.

What’s the process?

When you contact the team we will provide a Free Case Assessment to understand what has happened to you, listen what you would like to achieve and ensure that you have a valid case to bring. Once we have identified that you have a legitimate claim we will begin an investigation. In a group action this can be slightly different to a normal case as there will be parts which we can achieve as part of a wider group. Within this stage we will need to collect evidence, work out who is responsible and assess your injuries. When dealing with a group there may be efficiencies and hopefully you will be able to benefit from this. We will apply to the Court to let them know that we are dealing with the case. If needed we will get a Group Litigation Order. We will then negotiate with the defendants in order for us to try and reach a favourable settlement. Once we have a decision or an agreement of settlement we will arrange for the compensation to be paid to you.
