The most common causes of head injury claims include:

Road traffic accidents: Including pedestrian accidents, bike accidents, motorbike accidents, and car accidents. You can claim as a driver or passenger in Uber passenger accident claims and bus accident claims, too.

Accidents at work: You may be eligible to bring a head injury at work claim if your employer failed in their duty of care to you. This could include sustaining a serious head injury after a fall at work in situations where your employer gave you no PPE. Head injuries commonly occur in factory accidents and construction site accidents.

Slips, trips, and falls: You can bang your head against the floor or other surface in a public place like a supermarket or park. This is often because of hazards like wet floors, uneven paving, and potholes.

Sports: You could, for example, have an accident cycling, at the gym or during organised activities and holidays.

Assaults: If you suffered a head injury during a violent assault, a different process applies. Apply for head injury compensation through the Criminal Injuries Compensation Authority (CICA).

If you want to claim compensation for a head injury, you have three years to launch your case.

The clock starts on the date you had your accident. However, if you only realise later that the accident caused the symptoms you’re experiencing, you can start the clock from then. That’s called the date of knowledge.

Different rules apply for people under the age of 18. They can start legal action against the responsible person from the date they turn 18 until the date they turn 21.

If you lacked mental capacity when you had the accident, your clock starts when you regain capacity. From that point, you have three years to bring your head injury claim.
