Can I make a bulging disc compensation claim?

You can make a bulging disc compensation claim if someone else’s negligence caused your injury, whether that was an employer, another driver, or a medical professional. If your injury could have been prevented with proper care, training, or safety measures, you may have grounds to claim.

You may be able to claim if your injury happened in a road traffic accident, a workplace incident involving unsafe manual handling, a slip or fall in a public place, or as a result of substandard medical care. If your employer failed to provide proper training or a safe working environment, or if another driver caused a collision that damaged your spine, you could have a valid claim.

Having a pre‑existing back condition does not automatically prevent you from claiming. If the accident made your symptoms worse or aggravated an existing problem, you should still seek legal advice.

If you’re unsure whether your situation qualifies, it’s always worth speaking to us. In most cases, you have three years from the date of your injury, or from when you first connected your symptoms to the accident, to start a claim. We’ll give you clear, honest advice about your options.

Example of a bulging disc claim

A warehouse worker is asked to lift heavy stock without proper training or mechanical aids. They feel a sharp pain in their lower back, which is later diagnosed as a bulging lumbar disc causing sciatica and significant time off work. If the employer failed to follow manual handling regulations and provide adequate training, this could be a valid bulging disc compensation claim.

What compensation can help with

Recovering lost income and covering future care

Compensation for a bulging disc injury does more than acknowledge what happened to you. It also provides the financial support you need to access the right treatment, rebuild your strength, and manage the practical impact on your life.

A serious disc injury can affect your ability to work, limit your mobility, and require ongoing physiotherapy, pain management, or even surgery. Compensation can help fund this support, so you’re not left covering these costs yourself.

When valuing your claim, we consider the severity of your injury, how it affects your daily life and ability to work, and the level of care and treatment you’ll need in the future.

Successful bulging disc compensation claims may help fund:

  • Physiotherapy, pain management, and rehabilitation programmes
  • Injection therapy or surgical procedures such as discectomy or spinal fusion
  • Complementary therapies, including acupuncture or chiropractic treatment
  • Loss of earnings, including future losses if your ability to work is affected long-term
  • Private medical treatment and specialist consultations
  • Travel and transport costs related to your treatment and recovery
  • Costs of home adaptations or equipment if your mobility is significantly affected
Understanding the potential value

Arfon Hardy, whose herniated disc surgery resulted in catastrophic error and permanent paralysis, received a £3.125 million settlement plus £100,000 annually for life, following an interim payment of £800,000 secured by our team.

The value of a bulging disc compensation claim depends on the severity of your injury, the treatment you need, and the impact on your work and quality of life. Compensation varies widely, some cases settle in the lower thousands, while the most serious, life‑altering injuries can result in significantly higher awards.

Understanding interim payments

In serious cases, waiting for a claim to conclude can create real financial pressure, particularly if you’re unable to work or need to fund treatment in the meantime. Where possible, we’ll look to secure interim payments on your behalf.

These are payments made during the claims process, before the final settlement is reached. They can help cover immediate costs such as private treatment, physiotherapy, or necessary adaptations to your home. You shouldn’t have to wait until the end of your claim to access the support you need.

You're not alone

We understand what you're going through.

Living with a bulging disc affects far more than your back. The pain, sleepless nights, and inability to do the things you used to take for granted, like getting to work, lifting your children, and even sitting comfortably, can wear you down. It can also bring real anxiety about the future, whether the pain will improve, whether you’ll be able to work, and how you’ll manage the costs of ongoing treatment.

We also understand the financial strain that can come with a serious back injury. Lost income, the cost of private treatment, physiotherapy, and any adaptations you might need at home can add up, often at a time when you’re already stretched thin.

Many of the clients we’ve supported felt uncertain about whether they had a case, unsure who to trust, and worried about the process. What they found in Fletchers was someone to listen, explain things clearly, and take on the hard work so they didn’t have to.

That’s what we do. We’ll handle every part of your claim, keep you informed at each stage, and fight for compensation that truly reflects the impact your injury has had on your life.

FAQs about bulging disc compensation claims

What is the difference between a bulging disc and a herniated disc?

A bulging disc occurs when the soft centre of a spinal disc pushes outward through a weakened area of the outer layer, often causing back pain, numbness, tingling, or reduced mobility. A herniated disc, sometimes called a slipped or ruptured disc, involves a tear in the disc’s outer layer, allowing the inner gel to leak out and irritate nearby nerves.

Both conditions can be extremely painful and may form the basis of a compensation claim if caused or worsened by someone else’s negligence.

Can I claim compensation if I have a pre-existing back condition?

Yes. Having a pre-existing back condition does not automatically prevent you from making a claim. If the accident or negligence worsened your condition or aggravated your symptoms, you may still be entitled to claim compensation.

Medical evidence will help establish how much of your injury was caused or made worse by the incident in question, and we can help with that.

How much compensation can I expect for a bulging disc injury?

The value of your bulging disc claim depends on the severity of your injury, the impact on your daily life, the treatment you need, and any loss of earnings. Awards can range from a few thousand pounds to six or seven figures for life-altering injuries.

Our team can give you a clearer picture of what your claim may be worth once we understand the full circumstances.

How long does it take to settle a bulging disc compensation claim?

There is no fixed timeline for a claim to conclude. It depends on the complexity of your case, the evidence available, and whether liability is disputed. Straightforward claims can sometimes resolve more quickly, while complex or high-value cases may take longer.

Our team will work as efficiently as possible and keep you updated throughout the process.

How long do I have to make a bulging disc compensation claim?

In most cases, you have three years from the date of your injury, or from the date you first connected your symptoms to an accident or negligence, to start a claim. However, there are some exceptions to this rule. If you’re unsure whether you’re still within the time limit, speak to us as soon as possible, and we’ll advise you quickly.

What evidence do I need for a bulging disc compensation claim?

Medical evidence is central to any bulging disc claim. This typically includes:

  • Diagnostic imaging, such as MRI scans
  • Medical reports from treating clinicians
  • An independent medical expert’s assessment of your injury and prognosis
  • Accident reports
  • Witness statements
  • Photographs of your injuries
  • Documentation of your financial losses, including payslips and receipts for treatment costs
  • We’ll guide you through exactly what’s needed for your specific case and gather the evidence on your behalf.
What support will I receive during my claim?

From your first conversation with us, we’ll take the time to understand your situation and explain your options clearly. If your claim proceeds, we’ll handle all the legal work, keep you informed at every stage, and connect you with the medical experts and rehabilitation support you need.

Where possible, we’ll look to secure interim payments to help cover costs while your claim is ongoing. You also won’t face any upfront legal costs; we work on a ‘No Win, No Fee’ basis.
