Can I make a fairground or theme park accident claim?
You may be able to claim if someone else’s carelessness caused your injury. In legal terms, that’s called negligence. It means the person or company responsible for the ride or site didn’t take reasonable care to keep you safe, and that caused your injury.
There are a number of circumstances that can warrant theme park or fairground accident claims.
For example:
- A ride that was poorly maintained defective or operated incorrectly
- A restraint or harness failure
- Height, size or other safety restrictions not being properly applied
- Unsafe boarding or disembarking, including failures by attendants.
You may also be able to claim for slips, trips or falls caused by unsafe walkways, poor maintenance or other hazards around the fairground or theme park.
Under the Occupiers’ Liability Act 1957, the people or companies who control a site must take reasonable steps to keep visitors safe. HSE guidance also says fairground organisers must make sure visitors aren’t exposed to health and safety risks. If they fall short and you’re hurt, you may be able to claim against them.
To succeed, a claim usually needs to show three things:
- Duty of care: the operator, owner or organiser had a legal responsibility to keep you reasonably safe.
- Breach: they didn’t take reasonable care, for example by skipping a safety check or ignoring a fault.
- Causation: that failure caused your injury and the losses that followed.
We investigate all three for you. That means requesting inspection and maintenance records, safety procedures and staff training records, CCTV and incident reports, and speaking to witnesses. If a fault with the ride itself is involved, we can also look at whether the manufacturer or supplier is responsible.
If you’re not sure whether you have a claim, call us. We’ll listen to what happened and tell you honestly whether we think you have a case.
Example of a fairground or theme park accident claim
A visitor boards a ride and it starts moving before an attendant has checked their restraint. They’re thrown from the ride and break their leg. We’d look at whether the operator followed safe procedures. We’d request the ride’s inspection and maintenance records, staff training records, CCTV and the incident report, and instruct an independent engineer if needed.

What compensation can help with
Taking the financial pressure off while you focus on recovery
Compensation aims to put you back, as far as money can, in the position you’d be in if the accident hadn’t happened. It covers how the injury has affected your life, plus costs such as lost earnings, medical bills, rehabilitation and travel.
Successful theme park or fairground accident claims can compensate for:
- Pain, suffering and the impact on day-to-day life
- Loss of earnings and reduced ability to work
- Treatment, rehabilitation and therapy where appropriate
- Travel and other reasonable expenses linked to the injury
- Care and support needs
- Psychological support following a frightening or traumatic accident
- Longer-term needs in more serious injury cases, including adaptations or specialist equipment where relevant
Understanding the potential value
Theme park accident compensation is determined by factors such as the severity of your injuries, your recovery, any financial losses and the impact on your day-to-day life.
A broken leg that heals fully is valued very differently from a spinal injury that changes how you live. In serious cases we work with medical, care and rehabilitation experts to value your future needs, not just today’s.
A client story: support after a theme park ride malfunction
When an 11-year-old girl was injured after a ride malfunction at a UK amusement park, the consequences went far beyond the initial physical injuries. Alongside pain and hearing-related symptoms, the experience left her anxious and affected her confidence long after the incident itself. Our team supported her family, investigated how the malfunction occurred and helped them secure an outcome that acknowledged what she had been through and provided access to ongoing support.
Understanding interim payments
A serious injury can leave you out of work and facing bills long before a claim ends. Where the evidence supports it, we can ask the other side for interim payments. These are payments on account of your final compensation. They can help fund treatment, rehabilitation or lost income while we continue your claim. We’ll explain whether this could apply to you at your first conversation.

FAQs about fairground and theme park accident claims
How long do I have to make a fairground or theme park accident claim?
You usually have three years from the date of the accident to start a claim. If your injury only became clear later, the three years can run from when you first realised the accident caused it. For a child, the clock starts on their 18th birthday, so they have until they turn 21. If someone lacks mental capacity, the time limit doesn’t start until they regain it. Contact us as soon as you can, because evidence such as CCTV and ride records can be lost.
Who could be responsible for a fairground or theme park accident?
Who is responsible for a theme park or fairground ride accident can vary and will depend on the specific circumstances of the incident. Among the possible defendants in a theme park accident claim are:
- Park or site operator
- Ride controller/operator
- Organiser
- Contractor
- Equipment supplier/manufacturer or another party.
These cases can be complex and it’s important not to assume liability. A specialist solicitor can investigate the circumstances of your case and establish who was responsible.
Can I claim if I was injured on a fairground or theme park ride?
Yes, if you were injured on a fairground or theme park ride, you may be eligible to claim theme park injury compensation. Theme park owners or operators have a responsibility to keep people safe, so if you were injured due to negligence, you have the right to pursue a claim. A theme park accident claim could arise due to poor maintenance, unsafe operation, restraint failures, unsafe loading/unloading and other preventable safety failures.
Can I claim for an accident elsewhere in a theme park, not on a ride?
Yes, it’s possible to make a claim if you were injured at a theme park while not on a ride, if it can be proved that this was due to negligence. Examples include slips, trips or falls due to an unsafe walkway or obstruction, injuries due to crowd management failures, or being struck by a falling object.
Can I claim for my child after a fairground or theme park accident?
You can make a theme park or fairground ride accident claim on behalf of a child by acting as their litigation friend. A litigation friend is someone who instructs a solicitor on behalf of a person under 18.
The litigation friend does not receive the compensation personally. The fairground injury claim is brought for the child, and any damages awarded are intended to fund their future care, treatment, and support.
A court must approve any settlement for a child to make sure it’s fair, and the money is protected until they turn 18 unless the court decides otherwise. They have until they turn 21 to start a claim.
What if the fairground is temporary or travelling?
If you were injured at a temporary fairground it doesn’t automatically mean you can’t claim compensation for a fairground accident. In cases like this, your solicitor will need to identify the organiser, ride operator/controller or other responsible parties.
A travelling fair is still responsible for visitor safety. We’ll identify the organiser, the ride operator and their insurer, even if the fair has moved on.
Can I claim if I was partly responsible for the accident?
If you were partly to blame, you can usually still claim. This is called contributory negligence. The court looks at how much each side was responsible and reduces your compensation by your share. For example, if an operator failed to maintain a restraint but you ignored a clear safety instruction, your compensation may be reduced. We’ll assess this honestly and challenge any unfair attempt to put the blame on you.
Can I claim for psychological injuries after a theme park accident?
Yes. A frightening accident can lead to anxiety, flashbacks, phobias or post-traumatic stress disorder (PTSD). If a medical professional diagnoses a psychological injury caused by the accident, you may be able to claim for it, including the cost of therapy. We’ll help you get the right medical evidence.
How common are theme park accidents in the UK?
Between April 2014 and March 2024, the HSE recorded 3,188 injuries at amusement parks, theme parks and funfairs in Great Britain, according to BBC reporting. That’s around 320 a year. If you’re one of them, we’re here to help you understand your options.
Can I claim for a fairground or theme park accident abroad?
In cases of fairground or theme park accidents abroad, your claim options will be determined by where the accident happened and how the trip or attraction was booked. If the theme park trip was part of a package holiday, there may be routes to claim. Overseas time limits and laws can differ, so it’s important to seek specialist legal advice as soon as possible.
What evidence can help your claim?
Collecting evidence where possible can be useful if you decide to pursue a fairground park accident claim. It can be helpful to keep:
Photographs or video of the ride, attraction or hazard where available
- The name and location of the fairground or theme park and details of the ride or attraction
- Witness contact details
- Accident report or reference details
- Medical records and details of treatment
- Receipts or records showing financial losses
Don’t worry, you don’t need to have all the information above before seeking legal advice. A theme park injury lawyer will help you understand what evidence is relevant to your claim and gather evidence on your behalf.
