Polly Herbert

Partner & Serious Injury Solicitor

Polly is a Partner and Solicitor in our team, with over 20 years’ experience in serious injury. She leads a legal team with a view to securing compensation for clients who have suffered life changing injuries; and supports bereaved families following injuries that have led to the fatal loss of their loved one. Polly’s particular experience in fatal collisions has allowed her to develop close relationships with many road safety charities; in particular, Road Peace who advocate on behalf of road crash victims and their families.  As a result, she has appeared on BBC Breakfast, North West Tonight and the Streets Ahead podcast, as a legal subject matter expert.


Fundamentally, Polly is a team player. She enjoys working with colleagues across all stages of their career and supporting them with their own development. As well as leading the civil case for her clients, Polly enjoys being part of the multi-disciplinary team, helping to co-ordinate rehabilitation. This is at the core as to why she loves her job; maximising the recoveries for her clients, helping them realise their potential, and to regain as much independence as possible. Polly has experience of being instructed on serious injury cases very soon after the incident has occurred; meaning that they are in need of more than just legal support. Often, clients feel vulnerable at this stage, and require financial and emotional support, as well as guidance on accessing rehabilitation. Polly ranks empathy, life experience and the ability to listen to her clients as just as important as her legal skills. She has supported families that have required adaptations to their homes or care and support in the community. Driven by making a difference to clients and their families during crisis, Polly takes great reward in being able to provide help and support to the people she represents. One of Polly’s proudest moments to date was when a client she had worked with and had settled a case for sent her his wedding video. He was walking down the aisle using an exo-skeleton that was paid for using the funds that she has secured for him.

Notable Settled Cases


The client, who was alcohol dependent prior to the accident, was visiting home for a family christening when he was knocked down crossing the road. The Defendant overtook vehicles travelling at the 30mph speed limit, and crossed into the opposite carriageway where our client was waiting to cross safely. The client was left with a life-changing brain injury. An offer to settle had been made on a 60:40 basis by the Defendant. Polly was recommended to take over the case as a second opinion was required. She took instructions, and with Polly’s input, the case ultimately settled on a 100% basis with substantial interim funds to enable the client to proceed with an alcohol detoxification programme and successfully move into the community with 1:1 24/7 support.


Polly’s client, a young, pregnant mother was tragically killed, and her surviving children left with life changing injuries following a major crash on M66. The case remains ongoing for now and Polly has been supporting the family throughout the criminal process, as well as a civil case. She attended Royal Courts of Justice in London in October 2023 to support the family who had appealed the criminal sentencing to see the Defendant’s sentence be raised and given the longest sentence for causing death by dangerous driving in England and Wales. The civil case is now in progress, and Polly has been asked to become a Trustee for a road safety education charity that the surviving family has created.


Polly is representing a gentleman with a traumatic brain injury who had been left without any neurorehabilitation following his injuries. He was about to be moved into a care home when Polly was instructed and within a matter of six weeks, had secured substantial interim funds to move him into a private neuro-rehabilitation centre for extensive treatment. The case is ongoing and Polly and her team are supporting the client with a return to the community and dealing with all aspects of welfare and safeguarding.


Polly’s client, who was alcohol and drug dependant prior to his accident, suffered a spinal cord injury when he was knocked down by a Dominoes delivery driver, who failed to stop at a red light. She secured funds to enable him to seek private treatment at the Royal Buckingham Hospital and secure a bungalow with 24/7 2:1 support in place.
