There are important exceptions. If the person affected was under 18 at the time, the three-year period does not begin until their 18th birthday. If they lack the mental capacity to manage their own legal affairs, the time limit may not apply unless capacity is regained. In fatal claims, family members usually have three years from the date of death or the date of any inquest, whichever is later.
